1. Agreement to Terms

By accessing our website, contacting us, or using services provided by Heritage Senior Care, LLC (“Company,” “we,” “our,” or “us”), you agree to these Terms of Service. If you do not agree, please discontinue use of our website and services.

2. Nature of Services

We provide non-medical in-home care services including, but not limited to:

  • Assistance with daily living (personal care, companionship, meal preparation).

  • Light housekeeping, shopping, errands, and transportation.

  • Medication reminders (not administration).

  • Support after hospital or rehabilitation stays.

  • Veteran care services.

  • 24/7 support and caregiver availability.

We do not provide medical, nursing, or clinical care. Our services are supportive, non-medical, and intended to enhance comfort, independence, and safety at home.

3. Eligibility

Services are available to individuals 18 years and older who require in-home care. Clients (or their legal representatives) must agree to provide accurate information regarding care needs, health limitations, and emergency contacts.

4. California-Specific Consumer Rights

As a California resident, you are entitled to additional protections under:

  • California Consumer Privacy Act (CCPA/CPRA): You have rights to access, correct, or request deletion of personal information.

  • California Civil Code §1789.3: If you have a complaint about our services, you may contact us directly at info@heritageseniorcare.com or (760) 720-7740. You may also contact the Consumer Information Division of the California Department of Consumer Affairs at 1625 North Market Blvd, Suite N112, Sacramento, CA 95834 or by phone at (800) 952-5210.

  • California Online Privacy Protection Act (CalOPPA): We maintain a publicly accessible Privacy Policy, which outlines our data handling practices.

5. Payments & Billing

  • Payment terms are outlined in each client’s Service Agreement.

  • Invoices are due as stated in the contract; late payments may result in suspension of services.

  • We accept private pay, long-term care insurance, and veterans’ benefits where applicable.

  • Clients remain financially responsible for services rendered.

6. Scheduling & Cancellation

  • We strive to accommodate requested schedules, but availability may vary.

  • At least 24 hours’ notice is required for cancellations or changes.

  • Services canceled without sufficient notice may be subject to cancellation fees.

7. Caregiver Conduct

All caregivers are screened, trained, and employed/contracted by Heritage Senior Care, LLC. We maintain high standards of professionalism, but clients must treat caregivers with respect and provide a safe environment.

8. Limitation of Liability

  • Our services are non-medical and supportive in nature. We are not liable for outcomes requiring licensed medical intervention.

  • To the fullest extent permitted by California law, we disclaim liability for indirect, incidental, or consequential damages.

  • Our total liability for any claim related to services shall not exceed the amount paid by the client for the service in question.

9. Intellectual Property

All website content, branding, and marketing materials are the property of Heritage Senior Care, LLC. Unauthorized reproduction, modification, or distribution is prohibited.

10. Termination of Services

We reserve the right to terminate services if:

  • Payment obligations are not met.

  • A client or household environment poses safety risks to caregivers.

  • Services extend beyond non-medical support.

Clients may terminate services in accordance with their Service Agreement terms.

11. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of San Diego County, California.

12. Changes to Terms

We may revise these Terms periodically. Updates will be posted on our website with a new effective date. Continued use of our services constitutes acceptance of revised Terms.
